I'm sorry, but this is just wrong. In Collin County, State District Judge Mark Rusch has ordered the release of Lisa Ann Diaz, less than three years after she murdered her children. The Plano woman had drowned her 3 and 5 year old daughters in their home's bathtub in 2003.
When she went to trial, she was found not guilty by reason of insanity. Now, less than three years later, her doctor's say she is cured and ready to be released. She would still be participating in an outpatient program and taking prescribed medication.
The Collin County District Attorney's office is unhappy about the scheduled release. Assistant District Attorney Greg Davis said, "Given Ms. Diaz's apparent swift recovery, Judge Rusch had no choice but to release her from the state hospital. Today's decision underscores the need to reform the insanity defense so that intentional killers are held responsible for their actions and don't return to our communities."
I think the judge was smart to wait until after election day to annouce his decision. This is the kind of thing that could have cost a judge his job, if announced a few days before an election.
